Terms of Service
These Terms of Service (“Terms”) govern your use of Komkos Creator Uploader (the “Application”), provided by Komkos (“we,” “us,” or “our”). By using the Application, you agree to these Terms.
1. Purpose of the Application
The Application enables an authorized user to upload or publish videos, images, captions, and related information to the user’s TikTok account through TikTok’s official developer services.
2. Eligibility and authorization
You may use the Application only if you are legally permitted to use TikTok and to enter into these Terms. You must authorize access through TikTok’s official authentication process and may revoke that authorization at any time through TikTok.
3. Your responsibilities
You are solely responsible for:
- All content you upload, publish, schedule, or otherwise submit through the Application.
- Ensuring that you own the content or have all permissions, licenses, releases, and consents required to publish it.
- Complying with applicable laws, TikTok’s terms, community guidelines, intellectual-property rules, advertising policies, and developer requirements.
- Reviewing captions, privacy settings, disclosures, and other publication options before submitting content.
- Maintaining the security of your device and TikTok account.
4. Prohibited use
You may not use the Application to:
- Publish unlawful, infringing, deceptive, abusive, harmful, or unauthorized content.
- Impersonate another person or access an account without permission.
- Evade TikTok’s safeguards, rate limits, review requirements, or platform restrictions.
- Distribute malware, interfere with services, or attempt unauthorized access to systems or data.
- Use the Application in a manner that violates TikTok’s policies or applicable law.
5. TikTok relationship
TikTok is a third-party service. The Application is not endorsed by, sponsored by, or affiliated with TikTok unless expressly stated otherwise. TikTok may change, restrict, suspend, or discontinue its APIs or your account access at any time under its own terms and policies.
6. Availability and modifications
We may modify, suspend, or discontinue any part of the Application at any time. We do not guarantee that uploads will be accepted, processed, or published, because publication depends on TikTok, network availability, content review, account status, and other factors beyond our control.
7. Intellectual property
You retain your rights in content you submit. You grant us only the limited permission necessary to process and transmit that content as requested. The Application and its original software, design, and documentation remain the property of their respective owner, subject to any applicable open-source licenses.
8. Privacy
Our handling of information is described in the Privacy Policy, which forms part of these Terms.
9. Disclaimer of warranties
To the maximum extent permitted by law, the Application is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, reliability, availability, or uninterrupted operation.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of content, data, revenue, profits, goodwill, account access, or business opportunities arising from or related to the Application.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
11. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold us harmless from claims, losses, liabilities, and expenses arising from your content, your misuse of the Application, your violation of these Terms, or your violation of another party’s rights.
12. Termination
You may stop using the Application at any time and revoke its TikTok access. We may suspend or terminate access when reasonably necessary to protect the Application, comply with law or platform requirements, or address a violation of these Terms.
13. Governing law
These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles, except where mandatory consumer-protection law provides otherwise.
14. Changes to these Terms
We may revise these Terms as the Application or applicable requirements change. The effective date at the top of this page will be updated when revisions are made. Continued use after an update constitutes acceptance of the revised Terms to the extent permitted by law.
